Introduction

These terms and conditions (the “Terms and Conditions”) govern the use of our website at https://tabseet.org (“the Website”) and other domains belonging to Tabseet including but not limited to the platform (“the Platform”). The website and the platform are collectively referred to as “the Service”. This Service is owned and operated by Tabseet Technology licenced by Govermnet of Bahrain with commercial registration number 126423-1.

By using our Service, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Use of Services

As a user of our Service, you agree to use our Service legally, not to use our Service for illegal purposes, and not to:

  • Harass or mistreat other users of our Service;
  • Violate the rights of other users of our Service;
  • Violate the intellectual property rights of the Service owners or any third party to the Service;
  • Hack into the account of another user of the Service;
  • Act in any way that could be considered fraudulent;
  • Post any material that may be deemed inappropriate or offensive; or
  • Spamming any of the emails or contacts listed on the Service.

If we believe you are using our Service illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Service. We also reserve the right to take any legal steps necessary to prevent you from accessing our Service.

Intellectual Property

General

Title to, and all Intellectual Property Rights in the Services including but not limited to name, logo, design, features, content, code, the website and any documentation relating to the Services remain the property of Tabseet (or its licensors). Users do not acquire any rights on Tabseet by using it, except for the limited license to access and use it according to this terms and conditions. Users must respect the intellectual property rights of Tabseet and not copy, modify, distribute, sell or otherwise exploit the service without any prior and express consent from Tabseet.

Ownership of Data

Title to, and all Intellectual Property Rights in, the Data remain your property. However, your access to the Data is contingent on full payment of the Tabseet Access Fee when due. You grant Tabseet a license to use, copy, transmit, store, and back-up your information and Data to enable you to access and use the Services and for any other purpose related to providing services to you.

Backup of Data

You must maintain copies of all Data inputted into the Service. Tabseet adheres to its best practice policies and procedures to prevent data loss, including a daily system data back-up regime but does not make any guarantees that there will be no loss or corruption of Data. Tabseet expressly excludes liability for any loss of Data no matter how caused.

Third-party Applications and Your Data

If you enable third-party applications for use in conjunction with the Services, you acknowledge that Tabseet may allow the providers of those third-party applications to access your Data as required for the interoperation of such third-party applications with the Services. Tabseet shall not be responsible for any disclosure, modification, corruption or deletion of your Data resulting from any such access by third-party application providers.

Trademarks

Tabseet, Tabseet’s logo, and any other product or service name or slogan contained in the Service are trademarks of Tabseet and its suppliers or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Tabseet or the applicable trademark holder. You may not use any meta tags or any other hidden text utilizing Tabseet or any other name, trademark or product or service name of Tabseet without our prior written permission. Also, the look and feel of the Service, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and trade dress of Tabseet and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned in the Service are the property of their respective owners.

Marketing

You authorize Tabseet to use your name, logo, and any associated trademarks for marketing or promotional purposes by placing your logo on Tabseet’s Service, marketing materials, and in other public or private communications with our existing or potential customers.

Billing and Payments

Subscription Fees, Payment, Taxes, and Refunds.

You shall be charged the Subscription Fee based on the Plan You choose for the Services. Unless otherwise specified in these Terms or in a Pricing Agreement, the Subscription Fees are (i) payable and due in full immediately upon each due date with respect to a Subscription until Your Subscription is terminated in accordance with these Terms;  and (ii) exclusive of any taxes, levies, duties, fees or other amounts assessed or imposed by any government authority (“Taxes”), for which You are solely responsible. You authorize Us and/or Our authorized agents, as applicable, to bill and automatically charge You the Subscription Fee, including for any Renewal Subscription Term (as defined below). You must notify Us of any change in Your payment account information, either by updating Your Account or via e-mail to hello@tabseet.org.

Delayed Payments/Non-payment of Subscription Fees.

Where We do not receive payment towards the Subscription Fees within the due date for a Subscription, You shall be notified of such non-payment. We must receive payments within a maximum of fifteen (15) days from the date of Our notice to You, failing which, in addition to Our right to other remedies available under law, We may (i) suspend Your access to and use of the Services until We receive Your payment towards the outstanding Subscription Fees; and/or (ii) terminate the Subscription in accordance with these Terms. In the event You in good faith dispute any charges invoiced by Us, You shall promptly pay all undisputed charges within the due date, and shall notify Us in writing of any such disputed amounts within fifteen (15) days of the due date, identifying in reasonable detail Your reasons for the dispute and the nature and amount of the dispute. All amounts not timely and appropriately disputed by the due date shall be deemed final and not subject to further dispute.

Subscription changes

You can change your subscription plan (Upgrades and Downgrades) at any time during the Term.

  1. Upgrades:

    • You can upgrade to a higher plan whenever you wish.
    • When you upgrade, the new subscription fees will apply immediately.
    • For the current month, you’ll be charged a prorated amount based on the upgrade.
    • From the next month onward, you’ll pay the full new subscription fees.
  2. Downgrades:

    • You can also downgrade to a lower plan if needed.
    • Downgrades may have specific conditions outlined in the agreement.
    • Please review the terms carefully before proceeding.
    • If eligible, your fees will be adjusted accordingly after the downgrade is processed.

Free Trial

We offer a 14-days free trial to new users who register with Tabseet. The account will not be charged and the subscription will be suspended until upgraded to a paid version at the end of the free trial.

Termination Consequences

Effects of Termination of a Subscription

Upon termination of a Subscription, all rights granted to You under these Terms will cease immediately. We shall not be liable to You or any third party for suspension or termination of Your Subscription if done in accordance with these Terms. Unless otherwise agreed, termination of these Terms will automatically terminate all associated Subscriptions. These Terms will automatically terminate when all associated Subscriptions expire or are terminated, and Your payment obligations are fulfilled.

Unless waived by Us in writing or where the total Subscription Fees has already been prepaid, if a Subscription is terminated by Us in accordance with Termination Consequences section of these Terms, in addition to other amounts You may owe Us, You must immediately pay the Remaining Subscription Fees.

Data Export

Following termination or expiration of a Subscription, We will retain the Account’s Service Data for ninety (90) days. After this period, We are no longer obligated to maintain or provide access to Service Data. However, We may retain Service Data as required by law or to protect Our rights. You are responsible for exporting Service Data before termination. If assistance is needed during the Data Retention Period, a reasonable fee may apply.

Refund Policy

If you terminate your subscription in accordance with the Termination Consequences section of these Terms and Conditions, and the reason for termination is due to an issue with the service, you may be eligible for a refund of the unused Subscription Fees for Services not rendered.

Prohibited Activities

You may not access or use Tabseet for any purpose other than that for which we make Tabseet available. Tabseet may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of Tabseet, you agree not to:

  1. Systematically retrieve data or other content from Tabseet to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  2. Make any unauthorized use of Tabseet, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  3. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  4. Make improper use of our support services or submit false reports of abuse or misconduct.
  5. Sell or otherwise transfer your profile.
  6. Attempt to impersonate another user or person or use the username of another user.
  7. Use any information obtained from Tabseet in order to harass, abuse, or harm another person.
  8. Use Tabseet as part of any effort to compete with us or otherwise use Tabseet  and/or the Content for any revenue-generating endeavor or commercial enterprise.
  9. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of Tabseet.
  10. Attempt to bypass any measures of Tabseet designed to prevent or restrict access to the Service, or any portion of Tabseet.
  11. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of Tabseet to you.
  12. Copy or adapt Tabseet’s software, including but not limited to Flash, PHP, HTML, JavaScript, CSS (stylesheets) or other code.
  13. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of Tabseet or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Service.
  14. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
  15. Disparage, tarnish, or otherwise harm, in our opinion, us and/or Tabseet.
  16. Use Tabseet in a manner inconsistent with any applicable laws or regulations.

Modifications And Interruptions

We reserve the right to change, modify, or remove the contents of Tabseet at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Service. We also reserve the right to modify or discontinue all or part of Tabseet without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of Tabseet.

We cannot guarantee Tabseet will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to Tabseet, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Website at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use Tabseet during any downtime or discontinuance of Tabseet. Nothing in these Terms and Conditions will be construed to obligate us to maintain and support Tabseet or to supply any corrections, updates, or releases in connection therewith.
